Powerpools & Powercut Terms of Service & Conditions of Sale.

It is a fundamental principle of our trading that we wish to ensure your complete satisfaction from your dealings with us. What follows is the legal stuff…

Definitions: For the purposes of these terms of service & conditions of sale, “Powerpools & Powercut” means the business offering goods and services on this website and operating from the address given on the contact-us page of this website; “we” and “us” means Powerpools & Powercut, its owners, staff and associates; “you” and “your” means the person or business ordering goods under these terms and conditions or viewing information on this website. “Manufacturer” means the makers, importers or UK distributors of any item available on our website.
Website: This website is provided on an “as is” basis. No warranties of any kind are given or should be inferred regarding any written or printed content or any item(s) of information supplied within this site. Neither Powerpools & Powercut nor any of its owners, employees, or other representatives will be liable for damages arising out of or in connection with the use of this site or from the use of links to other sites. All trademarks, product names and company names or logos cited are the property of their respective owners. No permission is given to anyone whatsoever for the use of such trademarks, product names and company names or logos and such use may constitute an infringement of the holders’ rights. Certain remaining design, text, graphics and layout within this site are the copyright of Powerpools & Powercut. Permission is granted for the use and printed reproduction of portions of this site for the sole purpose of obtaining information during the process of ordering goods from Powerpools & Powercut or during the use of this site as a shopping resource. Any other use of the materials contained on this site or the copying of portions of this site for purposes other than noted above is strictly prohibited.

Suitability recommendations: Certain items may have recommendations for certain uses and or users.(e.g. a childs’ age suitability for certain toys.) Recommendations such as these are for general guidance only and cannot take into account all factors that may be relevant. We are available to discuss with you all issues of any purchase during the decision process. We wish to assist you with help and advise as often and as much as you would wish, however it is the responsibility of you the customer to finally decide the suitability of any item prior to purchase.


Ordering: When ordering goods on Powerpools & Powercut’s internet systems or via any other system presented by this website or any other website associated with Powerpools & Powercut, you are responsible for ordering the items and quantities that you wish to receive.  Should you place orders using manufacturer part numbers, you will need access to your own manufacturer parts lists to obtain these numbers. We may be able to supply these for you by prior arrangement. We may not accept returns based on the incorrect ordering of items, if the item supplied is that which you ordered. Please take care to check the part number and verify the description given as we are unable to check this for you. Please take care that you do not “double” the order by sending us a confirmation that would appear to be a new order. Any order confirmation should be clearly marked as such. Please check all items upon delivery and contact us within 24 hours should there be any issues such as damage. Should you require assistance, please contact us on 01267 235625 without delay.

Payment, title and risk: Payment for goods ordered is due on request. Unless prior arrangements have been made in writing, all goods purchased via our website(s) are due for payment with order. All goods remain the property of Powerpools & Powercut until paid for in full. Powerpools & Powercut are to be allowed access at any reasonable time to retrieve any goods supplied should these payment conditions not have been met. The customer assumes all risks associated with the goods upon receipt or delivery.


Safety First: Machinery can be dangerous. Never use an item of machinery if you are unsure of its safe operation or unable to use it safely. With every sale of machinery or equipment we provide a professionally recognised machinery installation/familiarisation training session, given by qualified personnel. Key members of our staff have met standards laid down by BAGMA, ROLO & the HSE and are fully certificated for the purpose of machinery installation. We provide you,  (the customer),  with this high level of safety awareness free of charge when given with the purchase of any equipment from Powerpools & Powercut. Note that this training is only available free of charge when given at our own main premises near Carmarthen,  prior to the shipping of the equipment. It is the customers responsibility to ensure attendance of this training session during the period offered. Should anyone require this level of training outside this period or these conditions, the charges are as follows: (1) At the premises of Powerpools & Powercut: £95 + vat per person per machine. (2) At the customers premises, within 75 miles of Carmarthen: £200 + vat per person per machine. (3) At the customers premises, 75 to 250 miles from Carmarthen: £350 + vat per person per machine. (4) For any other, ask us to quote.  It is an important condition of sale that the customer agrees not to attempt to use, or to allow the use of, any machine or equipment supplied by Powerpools & Powercut until that customer has taken all necessary steps to become fully conversant with the safe operation of the unit. Furthermore the customer agrees not to use or allow the use of the machine without first ensuring that all safety components are functioning correctly.  It is the responsibility of the customer to ensure that any goods purchased from Powerpools & Powercut are only used by appropriate persons and within safe situations and that due care will be exercised to protect both themselves and others from all associated risks.
Delivery: Powerpools & Powercut normally dispatches items on the day they are ordered with us. Due to the large and diverse range of items offered we are not able to always guarantee overnight delivery, however this is our goal. Contracted couriers are mainly used for the safe delivery of your order. Whilst we treat all orders as urgent we are unable to guarantee a delivery time on any goods. Actual delivery dates and times are usually notified by prior consultation at the time of sale. For items ordered on P.O.P.S. (Powerpools & Powercut Online Parts System), delivery is usually made on the second working day following our receipt of your order and after we receive payment. Our cut-off time for daily ordering is around 4pm. However, please ensure that you order as early as possible during any day. All orders and our ability to supply them are dependent upon availability, both in our stores or that of our suppliers.


Finance: Powerpools & Powercut is licenced by the Office of Fair Trading to carry out Credit Brokerage. Customers should note however that whilst we act as a credit intermediary for the purpose of providing finance, we are NOT independant, as we do not offer the products of all available lenders.
Warranty: All items sold as “new” will carry the full manufacturers warranty. Should an item be purchased from the “Used Sales” pages of our websites www.powerpools.co.uk & www.powercut.co.uk and sold as previously used (otherwise named “secondhand”), it will be clearly marked as such in our advertisements and will carry a different warranty. You are advised to check with us regarding the specific warranty attached to any individual item. New items supplied will carry a standard manufacturers warranty against defects of manufacture and the full details of any warranty period will be available from us on request. All the items we supply as new are backed up by ourselves and/or a nationwide network of manufacturer appointed agents that are authorised to carry out warranty work. To obtain warranty from ourselves or any other suitable repair centre, proof of purchase would be required. Warranties do not include the costs of transportation and therefore the cost of transportation will be borne by the customer. Please note that the customer must also comply with all the manufacturers terms of warranty.

Privacy: We will need certain information from you to help us process your order and maintain our business relationship with you. For the purpose of delivery, we will need to pass some of your information to a courier. We collect and hold such information securely and in accordance with the Data Protection Act 1998. General: We reserve the right at any time to revise any or all prices without prior notice. All orders for products are subject to availability irrespective of information previously supplied. Powerpools & Powercut reserves the right to refuse to supply any individual, company or organization for whatever reason. No liability will be accepted for any form of consequential loss due to the supply of any faulty or incorrectly supplied goods. Should any item(s) have been under priced in error, we will not be liable to supply that item to you at the stated price, provided that we have informed you before the item is sent to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at the corrected price or to receive a full refund of any amount you may have paid.

Finally: We want happy, satisfied customers. We will work to maintain your trust in us.  If there is a disagreement then hopefully, common sense will prevail. If not, then…  These terms and conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Should legal proceedings commence then resolution is to be sought in the nearest available Court to Carmarthen. These terms do not affect your statutory rights as a consumer.
